Welcome to Homesearch Nigeria Limited (the "Platform" or "Homesearch"). These Terms & Conditions ("Terms") govern your access to and use of the Platform, including any related services, listings, tools, and communications. By accessing or using the Platform you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Platform.
1. Acceptance of Terms
By registering, listing properties, browsing, or making rental/purchase requests on Homesearch, you accept and agree to be bound by these Terms and all applicable laws and regulations of the Federal Republic of Nigeria.
2. The Platform & Our Role
Homesearch provides an online marketplace that connects property owners, agents, and prospective tenants/buyers. Homesearch acts as a facilitator and advertising platform and does not itself own, rent, sell, or manage physical properties listed on the Platform unless explicitly stated.
3. Accounts & User Duties
- Account accuracy: You warrant that all information you provide is accurate, current, and complete.
- Authorized use: You must not impersonate others or use another user"s account without permission.
- Prohibited activities: Fraud, misrepresentation, posting unlawful content, or any activity that harms other users or the Platform are strictly prohibited.
4. Property Listings
All listings must truthfully describe the property. Listings that are false, misleading, illegal, or that violate our content policies may be removed without notice. Homesearch does not verify every listing and is not responsible for the accuracy of listings posted by third parties.
5. Transactions, Fees & Payments
Any financial transactions (rental deposits, sale proceeds, agency fees, or otherwise) occur directly between the parties involved unless Homesearch offers an explicit escrow or payment service. Homesearch may charge fees for premium features; such fees will be disclosed prior to purchase. Payments are non-refundable except where explicitly stated.
6. Joint Listings, Multiple Agents & The Special Clause
In some situations, a single property may be listed or represented by multiple parties (for example, two agents or two co-lessees). To reduce disputes and ensure clarity in commission or proceeds allocation, the following rule applies to all transactions facilitated through or advertised on the Platform:
Special Clause — Joint Lease / Dual Representation
Where two (2) or more individuals or agents claim the right to lease or otherwise conclude a transaction for the same property, the party who successfully completes the transaction (i.e., collects binding payment from the tenant/buyer and executes the legally binding lease or sale documents) shall be entitled to full rights over the proceeds and benefits derived from that transaction.
Other parties claiming prior or partial interest in the same listing shall be deemed to have waived rights to the proceeds of that particular transaction unless there is a separate, prior written agreement between the parties that states otherwise. This clause does not remove the right of a party to pursue a contractual claim against another party outside the Platform where a written agreement exists.
7. Dispute Resolution
Homesearch does not mediate disputes between users as a matter of routine. If a dispute arises, users should first attempt to resolve the issue directly. Where resolution cannot be reached, parties may pursue mediation, arbitration, or civil action under Nigerian law. Homesearch may cooperate with authorities and provide information when required by law.
8. Warranties & Disclaimers
To the fullest extent permitted by law, Homesearch provides the Platform "as is" and makes no warranties of any kind regarding listings, suitability, or legality of properties. Homesearch disclaims liability for any direct, indirect, incidental, or consequential damages arising from use of the Platform.
9. Limitation of Liability
Except where prohibited by law, Homesearch"s total liability for any claim related to the Platform is limited to the amount of fees actually paid to Homesearch by the claimant in the twelve (12) months preceding the claim, or ₦50,000 (fifty thousand naira), whichever is greater.
10. Termination & Suspension
We may suspend or terminate accounts that breach these Terms or where we suspect fraudulent activity. Users may also deactivate their accounts at any time.
11. Changes to Terms
Homesearch may update these Terms from time to time. We will post changes on this page and, where appropriate, provide notice to account holders. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the jurisdiction of Nigerian courts unless the parties agree to an alternative dispute resolution mechanism.
